General terms and conditions (GTC) / cancellation policy (§7 GTC)
1. SCOPE
1.1 The following general terms and conditions apply exclusively to the business relationship between the customer and NB Fashion GmbH (Love Joy Victory).
1.2 Part of the contract are the general terms and conditions in the version valid at the time of the contract.
1.3 We sell our goods exclusively to end consumers and only in normal household quantities.
2. COPYRIGHT & INDUSTRIAL PROPERTY RIGHTS

It is forbidden to reproduce, distribute or for commercial purposes any material that is protected by copyright, trademark, competition law or any other kind of protection, in particular texts, images, graphics, software, videos, music, brands, logos and other company symbols without prior written consent use.

4. CONCLUSION OF CONTRACT/DELIVERY CONDITIONS
4.1 The presentation of the products in the online shop is not a legally binding offer, but a non-binding online catalog.
4.2 By clicking the “Buy now” button, you are placing a binding order for the goods in the shopping cart, which is the offer to NB Fashion GmbH.
4.3 The receipt of the order is confirmed immediately after the order has been sent.

5. INSTRUCTIONS ON CANCELLATION AND RETURN OF GOODS

by means of a clear declaration (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. If you make use of this option, we will send you a confirmation of the receipt of such a cancellation immediately (e.g. by email). To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.
5.2 Consequences of the revocation:
a) If you withdraw from this contract, we will give you all the payments that we have received from you, including delivery costs (with the exception of the additional costs that result from the fact that you choose a different type of delivery than the cheap one we offer Standard delivery), to be repaid immediately and at the latest within fourteen days from the date on which we received notification of your cancellation of this contract. For this repayment we use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment.
b) We can refuse the repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.
c) You have to return or hand over the goods to us immediately and in any case no later than fourteen days from the date on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of thirty days has expired.
5.3 Return of goods:
In accordance with the directive of the European Parliament and of the Council on consumer rights, the customer has a right of withdrawal, which he can exercise without giving reasons within a period of fourteen (14) calendar days from receipt of the goods.This 14-day withdrawal period adds a maximum period of 14 Days in which the customer has to return the article (s) in perfect condition, complete (including accessories, labels ...), not soiled or washed and in the original packaging with the return slip to the end sender.

The return costs are borne by the customer. The reimbursement of the calculated price of the returned items will be made via the payment method selected by the customer when ordering, with the exception of the return costs to be borne by the customer, within fourteen (14) days of receipt of the return request or, if the goods are at a later point in time in our logistics center arrives after receipt of the return or its proof of delivery at the company.
6. WARRANTY
6.1 We reserve the right to deviate in structure and color, provided that these are due to the nature of the materials used and are customary in the trade.
6.2 When asserting the warranty rights, the defectiveness of the item must be pointed out and, in contrast to the right of return (see § 5), it must be communicated whether a replacement delivery is desired. Even in the event of a warranty, the right of return exists in accordance with Section 5 of the present contractual conditions.
7. ASSIGNMENT
The claims against NB Fashion GmbH may not be assigned.

9. FINAL PROVISIONS
The law of the Federal Republic of Germany applies to the exclusion of the UN sales law.
10. RETENTION OF TITLE
10.1 The delivered goods remain the property of NB Fashion GmbH until the claim against the customer from this purchase contract has been settled in full.
10.2 The customer is obliged to treat the goods with care for the duration of the retention of title.
10.3 He must notify NB Fashion GmbH immediately of any change in ownership of the goods or a change of address.
Alternative dispute resolution in accordance with Art. 14 Para. 1 ODR-VO and § 36 VSBG:
The European Commission provides a platform for online dispute resolution (OS), which you can find at https://ec.europa.eu/consumers/odr . We are neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
